Our Real Estate Dispute Defense Practice
We handle the defense of a broad range of real estate claims, including:
- Breach of the warranty of habitability. We defend residential and commercial landlords sued by tenants for the existence of conditions such as lack of heat, broken windows, mold, pests or lack of electricity that allegedly render the premises uninhabitable.
- Land movement or landslides. We defend homeowners, as well as contractors, in cases that might be brought by other homeowners or homeowner associations concerning land movement as a result of negligent construction, over irrigation or other claims of improper grading or irrigation, or other activity that could cause soil movement. - Homeowner and homeowner association (HOA) disputes. - Nuisance or trespass. We handle the defense of claims involving trespass that could cause either property damage or bodily harm as the result of an alleged wrongful entry onto someone else's property. We also defend nuisance claims made by one neighbor against other neighbors on issues such as noise, noxious fumes or other improper conduct, or the maintenance of property by one neighbor that impacts the property of the adjacent neighbor
