APPROACH TO LITIGATION

With each case assignment, we have an initial client meeting to discuss factual and legal issues that impact a given case. We develop a litigation strategy in concert with the client. We make certain the client agrees to the litigation strategy and its objectives.

We also provide a litigation budget for the client, so that the client may fully understand the approximate cost of the litigation that will be pursued.

We also seek authority from the client to undertake discovery activities, which often can be expensive and protracted.

At all times, we keep the client advised of the progress of litigation through either periodic reports or telephone conference. We communicate regularly with any client concerning the possible financial exposure on the case from both a cost standpoint and an indemnity standpoint. We discuss settlement possibilities with the client as soon as it is possible for our attorneys to evaluate both liability and damages issues, and develop a settlement approach to the case.

We attempt to obtain early resolution of litigation to the client in a way that is beneficial both from a cost standpoint and an indemnity standpoint, in order to minimize those risks to the client.

The attorneys in the firm hold memberships in a number of organizations, including the following:

1. American Board of Trial Advocates. Mr. Cummings has been on the National Board of Directors since 2003 and will continue until at least 2008.

2. Association of Business Trial Lawyers.

3. Apartment Association of Orange County. Mr. Cummings is on the Board of Directors for 2006.

4. Apartment Association of California Southern Cities.

5. Apartment Owners Association.

6. Orange County Asian American Bar Association

TRAINING

Our firm is available to provide training to our clients on a variety of subjects, including loss prevention, investigation and control of potential claims at early stages and employee training on substantive areas of law that impacts our clients, as well as subjects of training that may be suggested by clients concerning areas of the law that impact individual clients.
